Imparable League – Terms, Conditions & Participation Waiver

IMPORTANT – PLEASE READ CAREFULLY BEFORE REGISTERING

These Terms, Conditions and Participation Waiver apply to all Imparable League competitions, divisions, grades, fixtures, finals, training activities and associated events.

By completing a registration, making payment, selecting “Yes, I agree”, or permitting a registered minor to participate, the participant and/or their parent or legal guardian confirms that they have read, understood and agreed to these Terms.

1. Acceptance of Terms

I confirm that I have read, understood and agree to these Terms, Conditions and Participation Waiver.

If the registered participant is under 18 years of age, I confirm that I am their parent or legal guardian, or that I otherwise have lawful authority to provide consent on their behalf.

Acceptance of these Terms is a condition of participation in Imparable League.

2. Nature of Imparable League

Imparable League is a new, independently operated standalone sport and competition with its own rules, playing format, competition structure and administration.

Imparable League operates independently and is not affiliated with, governed by, sanctioned by, endorsed by or operated in connection with any other sporting league, association, federation, governing body or major sporting organisation, unless expressly stated otherwise by Imparable League in writing.

Participation in Imparable League is participation in the Imparable League sport and competition only.

All participants, teams, coaches, managers, officials, parents, guardians and spectators must comply with the official Imparable League Competition Rules, Codes of Conduct, registration requirements, safety requirements and competition policies.

3. Registration and Eligibility

All information provided during registration must be true, complete and accurate.

This includes, where requested:

  • Participant’s full name
  • Date of birth
  • Gender
  • Contact information
  • Parent or guardian information
  • Emergency contact information
  • Relevant medical information
  • Uniform sizing
  • Team information

Imparable League may request reasonable evidence of age or identity where necessary to confirm eligibility.

Providing false or misleading information may result in a participant being suspended, removed from a team, deregistered or declared ineligible.

Registration does not guarantee placement in a particular team, grade or division.

Imparable League reserves the right to reasonably grade, combine, restructure or move teams between divisions where required to maintain a fair, safe and workable competition.

4. Registration Fees and Payment

The applicable registration fee must be paid through the approved Imparable League registration system unless an alternative arrangement has been expressly approved by Imparable League.

The current player registration fee is $210 per participant and includes the applicable Imparable League playing uniform and Imparable Athletics grip socks.

A registration is not complete until all required registration information has been submitted and payment has been successfully processed.

Where a payment is declined, reversed, disputed, charged back or otherwise remains unpaid, the participant’s registration may be suspended or placed on hold until payment is resolved.

5. Uniforms

Participants and parents or guardians are responsible for selecting the correct uniform sizes during registration.

Imparable League will make reasonable efforts to accommodate sizing changes where stock and production time permit; however, changes cannot be guaranteed once uniforms have been ordered, personalised or produced.

Uniform designs, colours, placement, sizing and minor production details may vary slightly from promotional images or digital mock-ups.

6. Refunds and Withdrawals

Registrations are not automatically refundable because of:

  • Change of mind
  • Participant withdrawal
  • Failure to attend
  • Missing individual fixtures
  • Personal scheduling conflicts
  • Change of team
  • Change of grade or division
  • Reasonable fixture or venue changes
  • A participant becoming unavailable
  • Suspension or removal resulting from a breach of competition rules or conduct requirements

Where uniforms, merchandise or personalised items have already been ordered or supplied, their value may be taken into account when determining any refund where permitted by law.

Nothing in these Terms excludes, restricts or modifies any consumer right or remedy that cannot legally be excluded.

If Imparable League cancels a substantial part of the competition and cannot provide a reasonable alternative, postponement, rescheduling, credit or other appropriate remedy, any applicable refund will be dealt with in accordance with Australian law.

7. Competition Changes, Weather and Cancellations

Imparable League may reasonably change competition arrangements where required.

This may include changes to:

  • Fixtures
  • Match times
  • Playing fields
  • Venues
  • Rounds
  • Divisions
  • Grades
  • Competition structures
  • Finals formats
  • Dates

Changes may be required because of circumstances including:

  • Wet weather
  • Extreme weather
  • Ground closures
  • Unsafe playing conditions
  • Venue requirements
  • Team withdrawals
  • Participant numbers
  • Emergencies
  • Safety concerns
  • Events outside the reasonable control of Imparable League

Reasonable efforts will be made to communicate material changes to affected participants and teams.

A reasonable rescheduling, field change, venue change or fixture change does not automatically create an entitlement to a refund where the competition can still reasonably be provided.

8. IMPORTANT RISK WARNING – PLAY AT YOUR OWN RISK

IMPARABLE LEAGUE IS A PHYSICAL CONTACT SPORTING ACTIVITY. PARTICIPATION INVOLVES INHERENT AND OBVIOUS RISKS AND PARTICIPANTS TAKE PART AT THEIR OWN RISK TO THE MAXIMUM EXTENT PERMITTED BY LAW.

Participation may involve strenuous physical activity, running, tackling, physical contact, collisions, falls, rapid changes of direction and contact with other participants, officials, equipment, goal posts, playing surfaces and surrounding areas.

Risks associated with participation may include, but are not limited to:

  • Cuts and abrasions
  • Bruising
  • Sprains and strains
  • Muscle injuries
  • Soft-tissue injuries
  • Joint injuries
  • Dislocations
  • Broken bones
  • Dental injuries
  • Facial injuries
  • Head injuries
  • Concussion
  • Heat illness
  • Dehydration
  • Collision injuries
  • Serious or permanent injury
  • Disability
  • In rare circumstances, death

Outdoor playing surfaces may also contain natural or temporary hazards including uneven ground, holes, divots, wet or slippery areas, mud and other changing surface conditions.

It is impossible to identify or eliminate every risk associated with participation.

By participating, the participant acknowledges and voluntarily accepts the inherent and obvious risks associated with Imparable League.

Participants must immediately stop participating and notify an official if they are injured, become unwell or believe that it is unsafe for them to continue.

9. Assumption of Risk and Limitation of Liability

To the maximum extent permitted by law, each participant voluntarily assumes the inherent and obvious risks associated with participation in Imparable League.

To the maximum extent permitted by law, Imparable League and its operator, employees, contractors, referees, officials, trainers, volunteers, authorised representatives and venue providers will not be responsible for injury, loss or damage resulting from:

  • Inherent or obvious risks of participation
  • Ordinary physical contact during play
  • Accidental collisions
  • Falls
  • Actions of other participants
  • A participant’s failure to follow Competition Rules
  • A participant’s failure to follow reasonable safety instructions
  • A participant choosing to participate while injured or medically unfit
  • Personal belongings being lost, stolen or damaged

Nothing in these Terms is intended to exclude, restrict or modify any guarantee, right, remedy or liability that cannot lawfully be excluded, restricted or modified.

Any limitation or exclusion contained in these Terms operates only to the maximum extent permitted by applicable law.

10. Fitness to Participate

The participant and/or their parent or guardian is responsible for determining whether the participant is physically capable of safely participating.

A participant must not take part when they know, or reasonably should know, that an injury, illness, medical condition or other circumstance makes participation unsafe.

Imparable League may prevent a participant from playing where an authorised official reasonably believes that participant is injured, unwell or otherwise unable to safely participate.

Where reasonably required for safety, Imparable League may request medical clearance before allowing a participant to return to play.

11. Concussion and Head Injuries

Participant safety takes priority over continuing a match.

Where a participant displays signs or symptoms reasonably consistent with concussion or a significant head injury, an authorised official, trainer or first-aid provider may immediately remove that participant from play.

A participant who has been removed because of a suspected concussion or head injury must comply with any applicable return-to-play requirements before participating again.

Parents, guardians, coaches and participants must not pressure an official or trainer to allow an injured participant to continue playing.

12. Medical Information

Participants and parents or guardians must disclose relevant medical conditions, injuries, allergies or other health information reasonably necessary for safe participation.

Relevant medical information may be made available where reasonably necessary to authorised Imparable League officials, trainers, first-aid personnel and emergency services for safety and treatment purposes.

Participants and parents or guardians are responsible for keeping relevant medical information current.

13. Emergency Treatment

By registering, the participant and/or parent or guardian authorises Imparable League representatives to provide or arrange reasonable first aid where required.

Where an injury or medical emergency occurs and the participant’s parent, guardian or emergency contact cannot immediately be contacted, permission is given for Imparable League representatives to obtain or arrange ambulance assistance or emergency medical treatment where reasonably necessary.

Any ambulance, hospital, medical or other treatment expenses remain the responsibility of the participant or parent/guardian except where another party is legally responsible for those expenses.

14. Insurance

Participants and their families are encouraged to consider whether they require their own private health insurance, ambulance cover and/or personal accident insurance.

Unless expressly confirmed otherwise by Imparable League in writing, no representation is made that individual participants are personally insured against every injury, medical expense, loss or other consequence arising from participation.

Any public liability insurance maintained by Imparable League or a venue must not be assumed to constitute personal accident insurance for individual participants.

15. Participant Conduct

All participants must behave respectfully and appropriately.

Participants must comply with:

  • Competition Rules
  • Codes of Conduct
  • Referee decisions
  • Safety requirements
  • Reasonable instructions from authorised officials
  • Venue rules

Dangerous, abusive, threatening, discriminatory, intimidating, violent or seriously unsportsmanlike behaviour will not be tolerated.

16. Parent, Guardian and Spectator Conduct

Parents, guardians and spectators must behave appropriately toward:

  • Participants
  • Children
  • Referees
  • Coaches
  • Managers
  • Officials
  • Trainers
  • Volunteers
  • Venue staff
  • Other spectators

Abuse, intimidation, threats, fighting, discriminatory behaviour or interference with matches or officials may result in removal from the venue and further disciplinary action.

Serious incidents may be referred to venue management, police or another appropriate authority where necessary.

17. Coaches, Managers and Team Officials

Coaches, managers and other team officials must comply with all Imparable League rules, policies and reasonable competition directions.

Team officials are responsible for assisting Imparable League in maintaining appropriate participant and spectator behaviour.

Team officials must not knowingly permit an unregistered, suspended, ineligible or otherwise unauthorised participant to take part.

18. Referees and Competition Officials

Referees and competition officials are required to make decisions during matches and competition administration.

Participants, coaches, managers and spectators must respect those decisions.

Abuse, harassment, intimidation or threatening behaviour toward referees or officials is prohibited.

Where applicable, competition, disciplinary and eligibility decisions may be reviewed through any review or appeals process established by Imparable League.

19. Disciplinary Action

Imparable League may take reasonable disciplinary action where a participant, team official, parent, guardian or spectator breaches:

  • These Terms
  • Competition Rules
  • Codes of Conduct
  • Safety requirements
  • Eligibility requirements
  • Venue requirements

Disciplinary action may include:

  • Formal warnings
  • Match suspensions
  • Competition suspensions
  • Removal from a venue
  • Deregistration
  • Team penalties
  • Other reasonable sanctions

Serious or repeated breaches may result in removal from Imparable League.

A participant is not automatically entitled to a refund solely because they are suspended or removed because of their own serious misconduct, subject to any rights that cannot lawfully be excluded.

20. Playing Fields and Venue Conditions

Participants acknowledge that sporting venues and outdoor playing areas may contain natural, temporary or changing conditions.

These may include:

  • Uneven ground
  • Wet areas
  • Slippery areas
  • Holes
  • Divots
  • Mud
  • Debris
  • Weather-related hazards
  • Equipment
  • Fencing
  • Goal structures
  • Other participants and spectators

Participants must exercise reasonable care when entering, using and leaving competition venues.

Any hazard noticed by a participant, parent, coach, manager or spectator should be reported to an authorised official as soon as reasonably possible.

21. Personal Property

Participants, parents, guardians and spectators are responsible for their own personal belongings.

To the maximum extent permitted by law, Imparable League is not responsible for property that is lost, stolen or damaged at competition venues unless liability cannot lawfully be excluded.

22. Photography, Video and Media

Photography and video may occur during Imparable League matches, events, presentations and associated activities.

By providing the required Photo and Media Consent during registration, the participant and/or parent or guardian authorises Imparable League and Imparable Athletics to photograph, film or otherwise record the participant.

Approved material may be used for purposes including:

  • Imparable League social media
  • Imparable Athletics social media
  • Websites
  • Competition promotion
  • Advertising and marketing
  • Highlight videos
  • Competition announcements
  • Promotional graphics
  • Future promotional material

No payment or compensation is payable merely because a participant appears in approved promotional material.

23. Privacy and Personal Information

Imparable League may collect personal information reasonably required to operate and administer the competition.

This may include:

  • Participant identification details
  • Date of birth
  • Contact details
  • Parent or guardian details
  • Emergency contacts
  • Relevant medical information
  • Team information
  • Uniform information
  • Registration and payment records

Information may be used for purposes including:

  • Processing registrations
  • Processing payments
  • Determining eligibility
  • Allocating participants and teams
  • Competition administration
  • Safety and emergency response
  • Communication with participants and families
  • Uniform fulfilment
  • Managing disciplinary or eligibility matters

Personal information may be provided to service providers reasonably required to operate the competition, including registration, payment and communication providers, as well as authorised competition personnel where required.

Imparable League will take reasonable steps to protect personal information in its possession.

24. Children and Parent/Guardian Authority

Where a participant is under 18 years of age, the person completing the registration confirms that they have legal authority to provide the required consent for that participant.

The parent or guardian confirms that they have read and understood the Risk Warning and understand the nature of the physical sporting activity in which the child will participate.

The parent or guardian accepts these Terms on their own behalf and, to the extent permitted by law, on behalf of the minor participant.

25. Competition Rules

All participants and team officials agree to comply with the current Imparable League Competition Rules and Code of Conduct.

Playing rules may vary between age groups, grades and divisions.

Imparable League may reasonably update its rules, operational procedures and competition policies where required for safety, fairness or effective competition administration.

Material changes will be communicated where appropriate.

26. Safety Directions

Participants must immediately comply with reasonable safety directions given by:

  • Referees
  • Trainers
  • First-aid personnel
  • Competition officials
  • Venue staff

A participant may be prevented from participating or removed from an activity where reasonably necessary to protect that participant or another person’s health or safety.

27. Team Allocation and Grading

Imparable League has final responsibility for competition grading and team allocation.

A team’s nominated age group or preferred division does not guarantee placement in that specific division.

Imparable League may reasonably move teams between divisions or restructure divisions where required because of:

  • Team numbers
  • Competitive balance
  • Participant safety
  • Team withdrawals
  • Operational requirements

28. Fixtures and Finals

Fixtures, rounds and finals formats are determined by Imparable League.

Competition schedules may change where reasonably necessary.

Qualification for finals may be subject to minimum match participation requirements, registration status, eligibility requirements and other Competition Rules.

Only properly registered and eligible participants may participate in finals.

29. Unregistered or Ineligible Participants

A person must not participate in an Imparable League match unless properly registered and eligible to play.

Using an unregistered, suspended, over-age or otherwise ineligible participant may result in penalties against the participant and/or team.

Penalties may include forfeiture of competition points, match results or other disciplinary action.

30. Participant Responsibility

Each participant is responsible for:

  • Following competition rules
  • Playing safely
  • Wearing appropriate equipment and footwear
  • Reporting injuries
  • Following reasonable safety directions
  • Respecting referees and other participants
  • Not participating while knowingly medically unfit
  • Providing accurate registration information

31. No Guarantee of Matches or Outcomes

Imparable League will make reasonable efforts to deliver the scheduled competition.

However, participation does not guarantee:

  • A particular number of minutes on the field
  • Selection in a particular position
  • A particular match result
  • A particular ladder position
  • Qualification for finals
  • Placement in a particular division
  • A particular opponent
  • A particular field or match time

32. Severability

If any part of these Terms is found to be invalid, unlawful or unenforceable, that provision will apply only to the maximum extent permitted by law.

The remaining provisions will continue to operate where legally possible.

33. Australian Consumer Rights

Nothing in these Terms is intended to exclude, restrict or modify any consumer guarantee, statutory right, remedy or liability that cannot lawfully be excluded, restricted or modified.

Where these Terms contain an exclusion or limitation, it applies only to the maximum extent permitted by law.

34. Governing Law

These Terms are governed by the laws applying in New South Wales, Australia.

35. Participant and Parent/Guardian Agreement

By selecting “Yes, I agree”, submitting registration and/or permitting the participant to take part in Imparable League, I confirm that:

  • I have read and understood these Terms, Conditions and Participation Waiver.
  • I have read and understood the Risk Warning.
  • I understand that Imparable League is a physical contact sport.
  • I understand that participation involves inherent and obvious risks.
  • I understand that injuries, including serious injuries, may occur.
  • I voluntarily accept the inherent and obvious risks associated with participation.
  • I understand that participation is at the participant’s own risk to the maximum extent permitted by law.
  • I agree to comply with the Imparable League Competition Rules and Code of Conduct.
  • I confirm that the information provided during registration is true and accurate.
  • I consent to reasonable first aid and emergency assistance where required.
  • Where the participant is under 18 years of age, I confirm that I have lawful authority to provide consent on their behalf.
  • I agree to comply with reasonable safety directions issued by authorised Imparable League officials.
